Terms of Service
Last updated: 1 September 2026
These terms apply when a business uses Invicta, a platform operated by Invincible Media Ltd, Cardiff, United Kingdom. By creating an account you agree to them.
The service
Invicta provides customer relationship management, a shared inbox for SMS, WhatsApp, Facebook Messenger, Instagram Direct and email, automated review requests, and automatic text replies to missed calls. Features may change as the product develops.
Your account
You are responsible for keeping login details secure and for everything done under your account. You must give accurate business details and tell us promptly if they change.
Acceptable use
- Only message people who have consented or with whom you have a genuine relationship.
- Honour opt-outs immediately; Invicta records them automatically.
- No unlawful, misleading, abusive or spam content.
- Do not incentivise, filter or suppress reviews. Review requests must go to all customers alike.
- Follow the rules of the underlying networks, including Meta's platform policies and Twilio's messaging policy.
We may suspend accounts that breach these rules or put our network access at risk.
Your data and your customers' data
You own your contact and message data. You are the data controller for your customers' information and we process it on your instructions, as set out in our Privacy Policy. You confirm you have the right to upload the contact data you import.
Fees
Setup fees are taken by card at signup. Recurring subscription fees are collected by Direct Debit under a mandate you authorise. Outbound messages come from your monthly allowance, with top-ups available from info@invinciblemedia.co.uk or 029 2168 0800. Late or failed payments may lead to suspension.
Cancelling
You can cancel with 30 days' notice by emailing support@invinciblemedia.co.uk. On cancellation you may export your data; it is deleted 24 months after the service ends.
Availability and liability
We aim for continuous availability but cannot guarantee it, and we are not responsible for outages at third party networks such as Meta, Twilio or your phone provider. To the extent permitted by law, our total liability in any 12 month period is limited to the fees you paid us in that period. We are not liable for lost profits or indirect losses. Nothing limits liability for death, personal injury or fraud.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
